7 Steps to Take Post-Accident

An accident can happen anytime, anywhere—a car accident in a parking lot, a slip-and-fall in a supermarket, or an injury on a construction site. Immediately after, it’s easy to feel overwhelmed and unsure of what you should do next. It’s important to realize, though, that taking the right steps immediately can protect both your physical health and your legal rights. Here’s a step-by-step guide to follow after an accident.
First, it’s important to realize that your safety and the safety of others is the top priority. In a car accident, move to a safe location if possible and turn on your hazard lights. In a slip-and-fall or if you’re injured at work, avoid moving if you think you’re seriously hurt, and call 911 immediately (or have someone call for you) if medical attention is necessary. Once everyone involved is safe, take the seven steps below.
Collect Contact Information
Gather the names, phone numbers, and addresses of everyone involved, including any eyewitnesses. For car accidents, exchange insurance details with the other driver (witness statements can strengthen your case if liability is disputed). For slip and falls or workplace accidents, obtaining all witness contact information can help your case immensely.
Document Everything
If it’s safe to do so, take clear photos of the accident scene, an injury, and/or any property damage. For car accidents, take photos of all vehicle positions, conditions of the road, traffic signs and take photographs of all involved vehicles. If you have a slip-and-fall or workplace accident, photograph the hazard and that caused the injury and the surrounding environment.
Don’t Make Statements
The minutes after an accident or fall can be stressful, but you must remain calm. It’s important that you are careful with your words—even an innocent apology can be misconstrued as admitting fault. Stick to the facts when speaking with others, including insurance companies and authorities.
Report the Incident
Notify the appropriate authorities or parties. For car accidents, call the police and have them complete a report. For workplace injuries, report the incident to your supervisor immediately. If you slip and fall at a business, inform the manager in charge, and get their contact information before you leave.
See a Doctor
After a fall, injury, or accident, you may feel fine. Even so, it’s critical that you get checked out by a medical professional. Some injuries, like a concussion, or internal bleeding, may not be immediately obvious. As soon as you complete your first visit, be sure that you keep all of your related medical records as they will be important for any potential claims.
Keep Detailed Records
Start a file to store all documents related to the accident: medical records, repair estimates, receipts for expenses, and written accounts of what happened and any photos. Keeping everything organized will make it easier to support your claim.
Contact a Personal Injury Attorney
Before speaking with insurance adjusters or signing any documents, be sure to consult an experienced personal injury attorney. They can protect your rights, guide you through the claims process, and help you seek fair compensation.
