Insurance Claims & Disputes
We trust insurance companies to act in good faith. They often don’t. When a carrier denies a valid claim or pushes a lowball settlement, our attorneys hold them accountable.
Insurers protect their bottom line. We protect yours.
It’s common for insurers to contest and deny valid claims. In other cases, they offer quick settlements that minimize the compensation you’re actually owed. Adjusters and company representatives are trained in strategies for protecting their employer’s profitability — not your recovery. We know how they operate, and we know how to overcome the tactics they deploy.
Common insurance disputes after a serious injury
Don’t negotiate alone. The carrier’s first move is rarely their best.
Denied or contested claims
When a carrier rejects a valid claim — or contests coverage that should clearly apply — we push back with the law on our side.
Lowball settlement offers
Quick settlements minimize what carriers pay out. We document the full extent of your losses — medical, financial, and personal — so the offer reflects reality.
Reservation-of-rights disputes
Receiving a reservation-of-rights letter means the carrier is signaling they may dispute coverage. Get counsel right away — before you respond.
Dedicated protection of your rights after an injury
If you’ve been injured and an insurer is involved, please don’t negotiate on your own and don’t simply accept whatever’s offered. At a time when you’re likely in pain and under stress, it’s critical to:
- Don’t sign forms or cash settlement checks without first consulting a qualified attorney — many releases waive rights you didn’t know you had.
- Get counsel immediately if you receive a reservation-of-rights letter — or are simply copied on one — indicating coverage may be disputed.
- Recognize the full impact takes time to assess. It can take many months to determine the full extent of your injuries and the financial compensation you’re entitled to.

Quick answer
An insurance bad-faith dispute arises when an insurer denies a valid claim, delays payment without reason, or offers a settlement far below the value of your losses. In California, insurers owe their insureds a duty of good faith and fair dealing (Cal. Civ. Code § 3294 and Comunale v. Traders & General Ins. Co. (1958) 50 Cal.2d 654). If a carrier breaches that duty, you may recover not just your policy benefits but also consequential damages, attorney fees, and punitive damages. Never sign a release or cash a settlement check until an attorney has reviewed the offer — many releases waive rights you didn't know you had.
