Terms of Service

Effective 06/08/2026

These Terms of Service (“Terms”) govern your use of the website operated by Bender, Kurlander, Hernandez & Campbell, APC (“BKHC,” “BKHC Law,” “we,” “our,” or “us”), located at bkhclaw.com (the “Site”), and any related services we provide. By accessing or using the Site or our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

2. No Attorney-Client Relationship

Use of this Site, submission of a contact form, or transmission of any communication does not create an attorney-client relationship between you and BKHC Law. An attorney-client relationship is established only after BKHC Law accepts representation in writing through a signed engagement agreement. Until such an agreement is in place, no information you transmit to us through the Site is protected as confidential or privileged.

3. Legal Information, Not Legal Advice

Content on the Site is provided for general informational purposes only. It is not legal advice and should not be relied upon as a substitute for advice from a licensed attorney about your specific situation. Laws change; case outcomes depend on facts; you should consult a qualified California attorney before acting on anything you read here.

4. Attorney Advertising

Some content on this Site may be considered attorney advertising under the California Rules of Professional Conduct. Prior results do not guarantee a similar outcome. Verdicts and settlements described on the Site reflect the unique facts of specific cases and are not predictive of results in other matters.

5. Confidential Information

Please do not send confidential, time-sensitive, or sensitive personal information through this Site, contact forms, or unsolicited email until you have spoken with one of our attorneys and an attorney-client relationship has been established in writing. Information transmitted before that point may not be protected by the attorney-client privilege.

6. Permitted Use

You may use the Site for lawful, personal, non-commercial purposes related to evaluating, retaining, or coordinating with BKHC Law. You agree not to:

  • Use the Site in any way that violates any federal, state, or local law;
  • Attempt to gain unauthorized access to any portion of the Site or any system connected to it;
  • Use automated scraping, mining, or harvesting tools without our written permission;
  • Transmit malicious code, viruses, or harmful content;
  • Impersonate any person or misrepresent your identity or affiliation.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, video, audio, page templates, and the underlying code — is owned by or licensed to BKHC Law and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any portion of the Site without our prior written consent, except for ordinary personal use (printing or saving a page for your own non-commercial reference).

8. Third-Party Links

The Site may contain links to third-party websites — including official sources for California statutes, court opinions, and professional organizations. These links are provided for convenience. BKHC Law does not control these sites and is not responsible for their content, accuracy, or privacy practices. Linking to a third-party site does not constitute endorsement.

9. Mobile Terms of Service & SMS Compliance

By providing your mobile telephone number and opting in to receive text messages from BKHC Law, you agree to the following Mobile Terms of Service.

9.1 Program Description & Brand Name. BKHC Law operates a mobile messaging program (the “Program”) to communicate with clients, prospective clients, and partners. The Program provides text messages regarding case consultations, active legal case updates, scheduling reminders, and administrative notifications.

9.2 Message Frequency. Messages are recurring. The exact frequency of text messages varies depending on your interaction with us, your current case status, and your communication preferences.

9.3 Cost & Fees. BKHC Law does not charge a fee for this Program. However, message and data rates may apply for any messages sent to you from us and to us from you, according to your mobile carrier’s rate plan.

9.4 Customer Support. If you are experiencing issues with the messaging program or have questions, you can reply directly to any message with HELP for assistance. Alternatively, you may contact our customer support team directly at 619-842-3232, or visit our contact page at https://bkhclaw.com/free-consultation/.

9.5 Opt-Out Instructions. You may opt out of receiving SMS text messages from us at any time. To cancel your subscription to the Program, text STOP to our number in reply to any message. You may also text END, CANCEL, UNSUBSCRIBE, or QUIT to opt out. After texting STOP, you will receive one final text message confirming that you have been unsubscribed. After this confirmation message, you will no longer receive SMS messages from us unless you explicitly opt back in.

9.6 Carrier Liability. Mobile carriers, network operators, and BKHC Law are not liable for any delayed or undelivered messages. Delivery of information and messages is subject to effective transmission from your wireless service provider network.

9.7 Privacy. We respect your privacy and protect your data. All information collected through the Program is governed by our Privacy Policy. Text messaging originator opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes.

10. Disclaimers

The Site and all content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. BKHC Law does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by California law, BKHC Law, its attorneys, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Site, including damages for lost profits, lost data, business interruption, or any other commercial losses — even if BKHC Law has been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BKHC Law and its attorneys, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your breach of these Terms.

13. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be enforced to the maximum extent permitted by law.

15. Modifications to These Terms

BKHC Law may update these Terms periodically. Updates will be posted on this page with a new Effective Date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
